While we endeavour to ensure that this website is normally available 24 hours a day, we will not be liable if for any reason this website is unavailable at any time.

DELIVERY

The product delivery charge is £7.99 within the MK postcode for same day or next day delivery including weekends. Please see the website for P&P charges relating to your postcode within the UK (excluding PO Box addresses).

Our local delivery service delivers on the working day of the order, if placed before 12:00 noon, within a 15-mile radius of Buckingham, at a cost of £7.99 per delivery.

Deliveries will not be made on Sundays or UK public holidays or the day after a public holiday. Where orders have been placed for delivery on any of these dates, we will deliver, where possible, the day before the date requested.

Should the recipient be away from the delivery address given with the order at the time of delivery, a card will be left confirming attempted delivery, stating where the delivery has been left – either a safe place or with neighbours as per customers’ instructions.

Flowers delivered/sent to business addresses and/or other organisations will be delivered to a main reception or collection point. We will require a signature at the time of delivery.

Our normal working days are Monday to Saturday inclusive, excluding public holidays, subject to some celebration days falling on Sunday, when we will be available. Details will be placed on the website when necessary or applicable.

Prices shown (or agreed) include VAT and exclude the cost of delivery.

Dispatch of products will be arranged only after we have received payment.

Order acceptance and the completion of the contract between you and Bouquet Chic will take place on the exchange of goods or on the dispatch of the products ordered through the website or by telephone.

All products will be at your risk from the time of delivery to you or your agent.

We take reasonable care to ensure that all details, descriptions and prices of products appearing on the website or otherwise provided to you are correct at the time, but this information may not always reflect the position when you place an order on the website or we order products for you.

In the event of supply difficulties, we reserve the right to substitute goods or packaging of similar quality and value.

We will treat all your personal information as confidential and keep it secure and use reasonable endeavours to comply with UK data protection and consumer legislation.

You will be given the option to receive information from Bouquet Chic by post, e- mail or telephone, about products, promotions or special offers which we feel may be of interest to you. In the event that you do not wish to be contacted for such purposes, please communicate this to us during the ordering process.

Weddings and Events

General

By placing/confirming any order on this website or by telephone or meeting, you are agreeing to these terms and conditions.

Payment

A 20% deposit is payable at the time your order is accepted and agreed. This is not refundable in any circumstances. Payment of the remaining 80% is payable minimum two weeks before the wedding or event date.

Payment

Access and Installation Arrangements

Where it is necessary for us to install flowers or other products you agree to arrange access for us to the premises at specific and agreed times. If for any reason we are unable to obtain access at the agreed times, we cannot guarantee the completion of the installation by the agreed times. We confirm that we will use our best endeavours to meet the timetable. We cannot accept liability for any damages or costs due to us being unable to gain access to premises at the agreed times.

Photographs

You agree that any photographs of our flowers or products taken by us at your event or wedding may be displayed on our website, social media or marketing materials. In the event that individuals are pictured we will seek your consent to display the pictures, which consent should not be unreasonably withheld.

Marketing

Please inform us if you are unhappy for your staff, brand, company name and logo to be referenced in our marketing and social media activities – including, but not limited to,: case studies, website, blog, Facebook, Flickr, Pinterest, Twitter and PR.

Changes, Cancellation and Amendments

We can accept changes to flowers, designs and products ordered up to four weeks before the wedding or event date and before final payment has been made. We cannot accept any changes after that time, but will use our best endeavours to ensure total satisfaction.

Payments (the 20%) made cannot be refunded if cancellation takes place less than two weeks before the date of the wedding or event.

You are responsible for the safe and complete, undamaged, return of items, products and props you may have hired. The agreed hire deposit will be returned at the time of return.

Our liability for losses you suffer as a result of us breaching this agreement is limited to the purchase price of the product you purchased. We are not responsible for indirect losses, which may occur as a consequence of the main loss or damage, including, but not limited to:

a. Reduction of enjoyment of special occasions, such as weddings or special parties.

b. Reduction in colour co-ordination or quality in pictures taken of events.

c. Damage to floristry, flowers, designs, products caused after delivery is made and signed for.

We will not be liable or responsible for any failure to perform or delay in performance of any of our obligations that is caused by events outside our reasonable control.

Events outside our reasonable control include: any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

a. Strikes, lock-outs or other industrial action.

b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.

d. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

e. Impossibility of the use of public or private telecommunications networks.

f. The acts, decrees, legislation, regulations or restrictions of any government.

g. Unusual weather conditions.

Our performance under any Contract is deemed to be suspended for the period of the event which is outside of our control

Regular Supply Of Flowers Or Other Products

Where we have agreed to supply you with flowers or other products the following are the main terms of our supply agreement;

We will agree to supply and deliver flowers to you on a weekly basis up to a minimum value per week, (including VAT).

The flowers will be delivered on a day of each week to be agreed between us, unless this is a Bank Holiday, in which case they will be delivered on the next working day or a day to be agreed.

We will supply appropriates vases and /or containers. You agree to take reasonable care of the arrangements, vases and containers and pay for replacements if they are damaged while in your care. We will report any damage to vases before they are removed from your premises. We will endeavour to replace any damaged arrangements within a reasonable time and will invoice you for such a replacement arrangement.

The content, and price if more than the agreed maximum value, of the flower arrangements will be as discussed and agreed with an appointed employees to be agreed, or appropriate representative, with details of any specific requirements to be communicated to us two working days before the normal delivery date. In the absence of specific requirements we will choose a varying range of seasonal flowers up to the maximum agreed value each week.

We will invoice you on a calendar month basis, for flowers delivered within that month and you agree to settle invoices on receipt of the invoice, by bank transfer – bank details available on request

A representative of your company or organisation will sign a delivery note in respect of each delivery of flowers, which will be retained by us.

We will use our best endeavours to ensure that all arrangements are prepared with fresh produce, but will undertake to replace any arrangements at no cost to you, should these arrangements materially deteriorate in appearance within five days of delivery, unless such deterioration is caused by you.

Special Events

When we agree to provide flowers or other products to you for a special event, our terms and conditions for Weddings and Events will apply.

We are only able to amend or cancel delivery orders before 12 noon, two working days before the delivery date selected, or as agreed between us in special circumstances.

GOVERNING LAW AND JURISDICTION

These terms and conditions shall be governed by in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts. It is prohibited to access the website from territories where its contents are illegal or unlawful. If you access this website from locations outside the United Kingdom, you do so at your own risk.

MISCELLANEOUS

You may not assign, sub-license or transfer any of your rights under these terms and conditions.

If any provision of these terms and conditions is found by any court to be invalid, the invalidity of that provision will not affect the remaining provisions which continue to have full effect.

Only the parties to these terms and conditions may seek to enforce them under the Contracts Act 1999.
